As reported by the first deputy chairman of the Anti-Corruption Agency Ulan Sarkulov, the introduction of criminal liability for promising or offering a bribe is one of the key initiatives of the bill.
"This issue has been on the agenda for 16 years. The need to adopt legislative measures to recognize the promise, offer of a bribe, and extortion of a bribe as criminal offenses was indicated in the UN Convention against Corruption, ratified by Kazakhstan back in May 2008. Recommendations for the criminalization of the promise and offer of a bribe on a permanent basis are contained in the reports of experts from the Organisation for Economic Co-operation and Development," Ulan Sarkulov said at a plenary session of the Mazhilis.
In accordance with the concept of anti-corruption policy, Anticor has been tasked with joining the Organisation for Economic Co-operation and Development Convention on Combating Bribery of Foreign Public Officials and the Council of Europe Convention on Criminal Law for Corruption in 2026. These documents oblige all participating countries to criminalise the promise, offer and demand of a bribe.
"In the process of developing amendments to criminalize the promise and offer of a bribe, the international experience of countries near and far abroad was carefully studied (...) This norm is also reflected in the legislation of most post-Soviet states," Sarkulov added.
Mazhilis deputy Nikolai Arsyutin stated that he supports the bill. At the same time, he asked how the intention to offer or promise a bribe would be proven in practice.
"After all, in judicial and investigative practice, cases related to bribery are considered difficult to prove crimes. Will this not lead to the unjustified prosecution of our citizens?" asked the Mazhilis deputy.
Ulan Sarkulov answered that there will be no "mass prosecution" of people.
"We looked at international practice - there are literally isolated facts, mostly of a preventive nature. Here it should also be noted that there are issues of supervision by the prosecutor's office and the court. That is, a question of a preventive nature," the deputy chairman added.
Earlier it was reported that the Criminal Code of Kazakhstan is being supplemented with a new article, which will provide for liability for the illegal provision of remuneration.
