Tengrinews.kz - The appellate court in Astana reviewed a complaint in the Bishimbayev case, in which relatives of the late Saltanat Nukenova requested an increase in the compensation for moral damages.
As is known, in September 2024, the Interdistrict Civil Court of Astana heard a case filed by Saltanat Nukenova's brother, Ayitbek Amangeldy, seeking compensation from Kuandyk Bishimbayev for material damages and moral harm.
Previously, Bishimbayev, who was convicted, was ordered to pay expenses related to the criminal case amounting to 6,877,672 tenge, as well as 10 million tenge as compensation for moral damages.
It is worth noting that Saltanat Nukenova's brother filed an appeal against this decision, requesting an increase in the moral damages compensation to 1.5 billion tenge.
"The case materials indicate that the defendant was found guilty of the plaintiff's sister's murder by a verdict that has come into legal force. The brother of the deceased reported experiencing moral suffering, deteriorating health, and loss of ability to work as a result of the tragic event. The deceased's parents declined to seek penalties in favor of the plaintiff.
The first-instance court stated that the death of a close relative undoubtedly had a negative impact on the plaintiff's emotional state and violated his personal non-material rights. The court partially satisfied the claim, basing its decision on the principles of reasonableness and fairness," reads the statement from the Astana court.
According to official data, the Collegium for Civil Cases of the Astana Court upheld the decision without change, dismissing the plaintiff's appeal.
The court rulings have come into legal force.
