Danilkhan Shagatayev reported that they won the first court case. He reminded that the family had previously filed a complaint with the Civil Aviation Committee.
"The Committee issued a protocol against Air Astana and sent the materials to the administrative court. This concerns the case of leaving a minor at the airport. As a result, we won the case, and the company was held administratively liable under part 2 of article 567 of the Administrative Offences Code. A fine of about 3,692,000 tenge was imposed," the lawyer stated.
Danilkhan Shagatayev clarified that legal proceedings with the airline FlyArystan are ongoing.
"We won the first case, which was administrative. The fine was imposed by the court for not providing accommodation to the child. The fine will go to the state. We have a separate civil dispute trial going on regarding compensation for the child's mother. It is still in the preparation stage. To be more precise, the civil claim has been accepted for consideration, and there has only been one court hearing so far. The case will be reviewed later," he said.
Recall that a Kazakh woman named Zhazira shared on her Instagram page that her twin daughters, Zere and Zaure, were returning from the USA with a group and an assigned guardian. They were supposed to transfer in Astana and continue their flight to Uralsk. However, the airline registered Zaure for the flight but not Zere.
