The Court of Astana has received the appeals from both convicts. Bishimbayev and Baizhanov are challenging the verdict. They are seeking Baizhanov's acquittal, citing a lack of evidence. Additionally, they request a modification of Bishimbayev's charge from "murder committed with particular cruelty" to "intentional infliction of grave harm to health, causing death by negligence," which would result in a reduced penalty.
"In their appeals, the convicts asked to acquit Baizhanov due to the absence of corpus delicti in his actions. They also requested a reclassification of Bishimbayev's actions under part 3 of article 106 of the Criminal Code, seeking a reduction in punishment and a retrial," the Court of Astana stated.
The Astana Court of Appeal received the criminal case on June 10, 2024, and has scheduled the hearing for June 26, 2024.
