Tax officials in Almaty region to pay over 100 million for two iPhones

Details of the case

During desk control, an individual entrepreneur was found to have understated income, after which he was sent a notice to eliminate the violations.

Tax officials demanded 5 million tenge from the businessman, promising in return not to block his accounts and to withdraw the notice. Later, through the mediation of another department head, they agreed to replace the 5 million tenge with two iPhone 17 Pro smartphones worth a total of 1.5 million tenge. After receiving the smartphones, the tax officials unjustifiably recognized the tax notice as fulfilled.

What sentence the court handed down

The defendants’ guilt was fully proven by the materials of the criminal case and their confessions.

When imposing the sentence, the court recognized their sincere repentance and the fact that they have minor children as dependents as mitigating circumstances.

The court fined the head of the department 52 million tenge, the head of the division 52.5 million tenge, and the intermediary 15 million tenge. All those convicted have been banned for life from holding positions in the civil service, local government bodies, the National Bank and quasi-public sector entities.

The smartphones were recognized as physical evidence and confiscated to the state. Compulsory payments to the Victim Compensation Fund were also collected from the convicted individuals.

The verdict has entered into legal force.
