Kazakhstan currently lacks a dedicated legal framework regulating AI. If adopted, the law will introduce a wide range of first-time measures, including penalties for generating deepfake media — AI-generated videos, photos, or audio recordings that mimic another person's face or voice.

According to Mazhilis deputy Yekaterina Smyshlyayeva, the penalties will initially target owners of services or platforms used to create deepfakes.

“We have included this prohibition. The current proposal sets fines for the owners of such systems — ranging from 15 to 100 monthly calculation indices (from 58,000 to 393,000 tenge in 2025), depending on the type of business,” Smyshlyayeva said.

She added that lawmakers are also considering the possibility of introducing criminal liability for the dissemination of deepfakes, though this has yet to be finalized.

“I can’t speak to the Criminal Code yet. Punishment will be introduced once the legal definition is formulated and undergoes the required approvals. The Criminal Code is a serious tool that must be used with caution because it involves many legal components,” she noted.

A deepfake is an image, video, or audio recording created using artificial intelligence to imitate real people. It can make it appear that someone said or did something they never actually did. Deepfakes may be used for entertainment — or for deception.
