The Zhanibek District Court reviewed the criminal case against three citizens of a foreign state charged under the article “Intentional illegal crossing of the State Border of the Republic of Kazakhstan” (Clause 1, Part 1-1, Article 392 of the Criminal Code).

What the court established

According to the Zhanibek District Court, on December 3, 2025, at around 9:30 p.m., the men illegally crossed into Kazakhstan from Russia, climbing over a double-row wire fence near the Kairat border post.

The next morning, they arrived in the village of Tau, where they hid in an abandoned building. About an hour after a local woman reported them, they were detained by police officers.

In court, the defendants fully admitted their guilt. They explained that they wanted to return to their home countries — Tajikistan and Uzbekistan — to be with their relatives. According to them, they feared for their lives because they were allegedly being forced to take part in combat operations.

The prosecution requested prison sentences for all three men.

In the end, the court found them guilty. Two of the men were sentenced to 6 months in prison followed by deportation from Kazakhstan. The third was fined 350 MCI (1,376,200 tenge) and also ordered deported from the country.

The verdict has entered into legal force.
