Tengrinews.kz — Kazakhstan is considering constitutional amendments that would reduce the maximum period of detention without a court decision from 72 to 48 hours.

The proposal was announced by Mazhilis deputy Snezhanna Imasheva during the second meeting of the Constitutional Reform Commission.

“Under the second paragraph, the threshold for detention without a court ruling is being changed — it will be no more than 48 hours. Detention for up to 72 hours will be allowed only in exceptional cases explicitly established by law,” Imasheva said.

In addition, the amendments introduce a mandatory requirement to inform detainees of their rights at the moment of detention. Every detained person must be clearly informed of the grounds for restricting their freedom and of their legal rights.
