Kazakhstan's Constitutional Council to interpret early presidential elections idea

The Senate of Kazakhstan’s Parliament has requested the Constitutional Council of Kazakhstan to provide an official interpretation of the Article 41 paragraph 3.1 of the Constitution of Kazakhstan that deals with early presidential elections, Tengrinews reports citing the official website of the Parliament’s upper house.

The Senate of Kazakhstan’s Parliament has requested the Constitutional Council of Kazakhstan to provide an official interpretation of the Article 41 paragraph 3.1 of the Constitution of Kazakhstan that deals with early presidential elections, Tengrinews reports citing the official website of the Parliament’s upper house.

On February 19, during the plenary session, the Senate considered the proposal of the Assembly of People of Kazakhstan to hold presidential elections in Kazakhstan early - this year instead of the scheduled next year. The Speaker of the Senate Kassym-Jomart Tokayev said that "this initiative was certainly timely."

At the end of the session, the Senate unanimously voted in favour of the early elections.

Guided by the Article 72 of the Constitution of Kazakhstan, Tokayev also appealed to the Constitutional Council of Kazakhstan to provide an official interpretation of paragraph 3.1 Article 41 of the Constitution that deals with early presidential elections and says that such elections can be called by a decree of the incumbent president of Kazakhstan and have to be held as prescribed by the Constitutional Law.

In case Nursultan Nazarbayev, who is eligible by law to run for President as many times as he wants, calls the early presidential elections in Kazakhstan, the voting will take place within two months from the date the decree to hold the elections is passed, according to the Constitutional Law On Elections in Kazakhstan. The following regular presidential elections shall be held five years later.

The previous elections were held ahead of time, on April 3, 2011, having been originally scheduled for 2012. The presidential elections in 2001 were called after an idea to hold a referendum to prolong the president term of Nursultan Nazarbayev until 2020 was rejected by the Constitutional Council. In 2011 President Nazarbayev was reelected for a new five-year term with 95.55 percent of the votes.
