Toyota permits Kazakhstani retailers to use its trademark

Kazakhstani sellers of car spare parts have finally been permitted to use Toyota trademark on they advertisement banners and leaflets, Tengrinews.kz reports.

BMF Group, the company representing Toyota in Kazakhstan, posted the terms of use on their official website.

Toyota Motor Corporation will no longer impede the use of Toyota and Lexus trademarks for advertisement purposes in Kazakhstan, but the entrepreneurs will have to comply with a number of conditions. Use of “Toyota” and “Lexus” words and logos is prohibited in names of store, domain names of websites and company letterheads.

Toyota Motor Corporation also prohibits use the trademarks to advertise spare parts purchased from unofficial dealers in the Customs Union. And the share of original Toyota and Lexus spare parts on the shelfs should not the less than 33% to make the advertisement ligitimate. Besides, the advertisement may not have trademarks depicted in Toyota’s red color.

In November of 2013, around 30 spare parts shops were closed down in Kazakhstan. The businessmen had received letters from Toyota Motor Corporation asking them to pay fines for illegal use of Toyota trademark and stop any further sales of the spare parts, and threatening them with lawsuits if they did not comply.

A BMF Group lawyer Zhanat Nurmaganbetov told the entrepreneurs that they were not banned from procuring the spare parts from official dealers or directly from Toyota Motor Corporation, and reselling them.
