Tengrinews.kz - The International Council of the Supreme Court proposed that banks and microcredit organizations write off loans for victims of internet fraud.

At a meeting of the International Council of the Supreme Court of Kazakhstan, they discussed the implementation of artificial intelligence in judicial processes and the protection of the interests of internet fraud victims.

"One innovative measure that could radically improve the situation would be a legislatively established obligation for credit organizations to write off debts when a court ruling confirms that a loan was fraudulently taken out without the client’s involvement. This provision should encourage credit organizations to take security measures for the loans they issue," the court stated.

Judges noted a sharp increase in cases related to internet fraud: in 2023, the number of such cases rose by 270 percent compared to the previous year. Law-abiding citizens fall victim to fraudsters, who pressure them into taking out loans and, in some cases, even selling their property.

Currently, victims can file lawsuits to recover funds from so-called 'droppers' — individuals whose accounts receive the money — and to challenge the actions of banks and microfinance organizations. The Supreme Court has already introduced practices for the return of illegally obtained funds.

To prevent fraud, the council participants proposed tightening criminal legislation, introducing mandatory biometric authentication for online lending, and setting restrictions for vulnerable groups and pensioners.

These recommendations will be sent to the authorized bodies for further implementation, the Supreme Court emphasized.
