Today, a court session took place in Astana regarding the appeal filed by the convicted individuals in the Denis Ten murder case.
During the session, the defense attorney representing the interests of Kudaibergenov and Kiyasov, Samat Sagidanov, addressed the court, requesting the acquittal of both. Afterward, the judicial panel retired to the deliberation room to make a decision.
"The judges have refused to refer the case for cassational review," the court's ruling states.
The Supreme Court upheld the sentence of the convicts.
In January 2019, Arman Kudaibergenov was found guilty of murdering Denis Ten and was sentenced to 18 years in a maximum-security facility. The second defendant in the case, Nuraly Kiyasov, was also sentenced to 18 years in a maximum-security facility.
In the case, Zhanar Tolybaeva was also involved. She was sentenced to 4 years in a medium-security facility but was released from custody a year later, in December 2019. The court decided to replace the remaining part of her sentence with a restriction of freedom due to her health condition and the fact that she had given birth while in custody. She later returned to the colony and was finally released in December 2021.
Denis Ten was a Kazakh figure skater who competed in singles. He was a distinguished master of sports of the Republic of Kazakhstan and a bronze medalist at the 2014 Winter Olympics. He also won a silver medal at the 2013 World Figure Skating Championships, a bronze medal at the 2015 World Championships, and was the champion of the Four Continents Championship in 2015, as well as the champion of the VII Asian Winter Games and a five-time champion of Kazakhstan.
Denis Ten was killed as a result of a conflict with car thieves on July 19, 2018, at the intersection of Kurmangazy and Baysitova streets in Almaty.
At that time, Arman Kudaibergenov removed the mirrors from the athlete's car. His accomplice, Zhanar Tolybaeva, was standing seven meters away from the vehicle but did not notice Denis Ten passing by. The figure skater, seeing unfamiliar people near the car, attempted to intervene. A fight broke out between Kudaibergenov and Ten. During this time, Nuraly Kiyasov pulled a knife from his backpack, approached from behind, and stabbed Denis Ten twice in the femoral artery. The wound proved fatal.
