What are these rules?

In Kazakhstan, there are existing regulations governing the transfer of information about issued or reserved tickets to authorized state bodies, including the police and special agencies such as the National Security Committee (NSC) and the State Security Service. These rules are tied to the country's transport legislation.

According to Article 24-2 of the transport law, all carriers — including foreign ones — as well as airports are required to transmit information about purchased or reserved tickets for passengers arriving in, departing from, or transiting through Kazakhstan. This data is shared in real time through automated systems.

What will change?

The Ministry of Transport has proposed expanding the scope of data analysis related to air passengers. The new provisions would allow for the use of passenger data not only for general safety purposes but also to prevent acts of terrorism, related crimes, and other serious international offenses, including organized crime.

“The draft amendments add objectives such as the prevention of serious transnational crimes, including organized crime,” the ministry stated in response to an official inquiry from Tengrinews.kz.

This means passenger data may be used, if necessary, to prevent serious international crimes.

What data will be shared?

According to the regulations, airlines must transmit flight and passenger data to the information system within 30 minutes after the check-in process ends. The data includes: flight code and number, arrival date and time, points of departure and arrival, route details (e.g. transit), last and first landing points of the aircraft, entry point into Kazakhstan, and the total number of passengers.

Personal data of each passenger is also transmitted: surname, first name, patronymic, date of birth, gender, citizenship, travel document details (type, number, expiration date, issuing country or organization), passenger status (e.g. crew member or transit passenger), seat number, baggage tag number, and the number of checked-in bags. If the passenger agrees, contact information (phone number, email) is also included. Additionally, a registration number and passenger ID are recorded.

Access to this data is granted to the Ministry of Transport, law enforcement agencies, and special services.
