The court determined that the parties had an agency agreement for nanny services.
In February of this year, the defendant posted on Instagram using the plaintiff's passport photo along with the caption: "Workers who fled deceitfully without fulfilling their employment obligations. Be extremely vigilant!"
A linguistic-psychological examination confirmed that the disseminated information could harm the honor, dignity, and business reputation of the plaintiff if proven false. The defendant failed to provide evidence to substantiate the accuracy of the claims.
As a result, the court ruled in favor of the plaintiff.
"The publication was deemed false and defamatory, damaging the plaintiff's honor and dignity. The court ordered the defendant to retract the information through the same media platform. Additionally, the defendant was ordered to pay moral damages amounting to 100,000 tenge. The decision has come into legal effect," the Astana Inter-District Civil Court stated.
