The Inter-district Criminal Court of Astana reviewed the case of a former police officer accused of exceeding his authority by unlawfully detaining Italian citizen M., who was suspected of drug distribution. In June 2023, minors K. and M., a native of Kazakhstan (now an Italian citizen), were detained for distributing drugs. During the investigation, 34 packages of mephedrone were seized from them.
"M. agreed to cooperate and revealed the locations of the drug stashes. At her request, she was placed in a safe house for 16 days to ensure her safety. In November 2023, the case against M. was dismissed due to procedural violations, and she left Kazakhstan, accusing the police of applying pressure.
Former police officer B. was accused of unlawfully detaining M., but the court determined that she was in the apartment of her own will and in accordance with the investigator's decision. The prosecution failed to prove B.'s abuse of power, as M.'s testimony was contradictory," stated the court of Astana.
The court found the former police officer not guilty, noting that his actions did not violate the law.
"The court verdict found B. not guilty of committing a criminal offense under paragraph 3 of part 4 of Article 362 of the Criminal Code and acquitted him due to the absence of criminal elements in his actions," said the Astana court.
The former police officer received an official apology, the preventive measure was lifted, and he was granted the right to compensation for wrongful prosecution.
Earlier, a Swiss citizen has been arrested for 20 days in Kazakhstan's Kyzylorda region for driving under the influence and causing a car accident.
