According to the Ministry of Justice, on October 25, 2021, the Committee of Highways of the Ministry of Transport signed a contract with F&A Road Construction for the reconstruction of the Kurty - Burylbaital highway. The committee paid the company an advance of 5.9 billion tenge for the mobilization of equipment and preparation of materials. However, the Turkish contractor did not start the work, and in May 2022, the contract was unilaterally terminated. Attempts by the Committee of Highways to return the advance amicably were unsuccessful.

"By the government's order, the Ministry of Justice initiated arbitration against the contractor and took active measures to recover the funds. In April 2024, together with the law firm White & Case LLP, they filed an application with the Arbitration Court of the International Chamber of Commerce in Paris. The priority was to recover state funds.

As a result, in June 2024, the contractor proposed a settlement, and on August 28, 2024, the Committee of Highways signed a settlement agreement. According to this agreement, the contractor is obligated to return the advance payment of 5.9 billion tenge by September 26, 2024, as well as compensate the Ministry of Justice's legal expenses: $280,000 for services (more than 134 million tenge) and $85,000 for the arbitration fee (over 40 million tenge)," the ministry reported.

The ministry clarified that they have three other similar potential disputes related to the failure to fulfill obligations and the non-return of advance payments by road contractors.
