Boston Federal Court has started hearing the Azamat Tazhayakov case, Tengrinews reports citing RIA Novosti.

Tazhayakov’s lawyer Nicholas Wooldridge reminded in his opening statement that his client was not accused of the actual bombing in Boston. The lawyer said that Tazhayakov “never took a backpack out of the dorm room, he never even touched that backpack, and he sure never tossed it”.

According to Tazhyakov, it was his roommate Dias Kadyrbayev who tossed Tsarnayev’s backpack. The lawyer added that Tazhayakov learned that his friend threw away Tsarnayev’s backpack during the interview with FBI agents. Moreoever, he was interviewed without a lawyer and voluntarily gave his cell phone to the agents, which, according to the lawyer showed Tazhayakov’s willingness to help the investigation.

Dzokhar Tsarnayev sent Kadyrbayev a SMS that said: “If you want, you can go to my room and take what's there”. Wooldridge said that it referred to marijuana.

Meanwhile, the prosecution is convinced that Tsarnayev told the Kazakhstani students that he could make a bomb and expressed admiration of the martyrdom one month prior to the terrorist attack. Assistant U.S. Attorney Stephanie Siegmann said that 90 minutes after the bombings Tsarnayev sent a text message that said, "Don't go thinking it's me" to Tazhayakov.
