Kazakh student Dias Kadyrbayev has been sentenced to a prison term in the US for obstructing justice during the investigation of the terrorist attack on Boston marathon which occurred in April 2013, Tengrinews reports citing RIA Novosti. Boston District Court sentenced Kadyrbayev to six years in prison. During the trial, Kadyrbayev admitted that he did not call the police after recognizing the suspect bomber - his friend Dzhokhar Tsarnaev. In addition, Dias Kadyrbayev admitted that he, together with another Kazakhstani student Azamat Tazhayakov, took away Tsarnaev’s things from his room in the dorm, which impeded the investigation. "I really can’t believe I acted so stupidly," he said.

He also apologized to the victims of the bombing and said he was ashamed.

According to the prosecution, Kazakhstani student Tazhayakov and Kadyrbaev carried items out of the room of Dzhokhar Tsarnaev - a backpack with a flash drive, petrolatum, pyrotechnics and a laptop - after they saw Tsarnaev’s picture on the news.

Because of that, the investigation team had to spend two days looking for Tsarnaev's backpack in a landfill. Moreover, the backpack and its contents were damaged.

Earlier it was reported that federal prosecutors asked the court to sentence Dias Kadyrbayev to seven years in prison. According to prosecutors, there was no evidence suggesting that Kadyrbayev knew that Tsarnayev was preparing to commit a terrorist attack in Boston. However, after the incident occurred and he saw Tsarnaev’s picture on the news, he should have reported to the police, instead of destroying important evidence.

The official representative of the Ministry of Foreign Affairs of Kazakhstan Altai Abibullayev said that the agency continued to provide consular and legal assistance to both Kazakhstani students.

"Amid the investigative and judicial process, we have and will continue providing all possible consular and legal assistance to Dias Kadyrbayev and Azamat Tazhayakov, whose fates worry our society and has attracted the attention of the international community. We are closely monitoring the situation around our citizens and studying all the legal and judicial sides of the case," Abibullayev wrote on his Facebook page.

Yesterday, on the sidelines of the meeting of the Mazhilis of the Kazakh Parliament, Abibullayev commented on the possibility of extradition of the students back to Kazakhstan.

"I would like to note that the Mazhilis of the Parliament of Kazakhstan has ratified an agreement on legal assistance between Kazakhstan and the United States. But as far as we know, the agreement for legal assistance does not provide for transfer of sentenced persons. For the citizens of Kazakhstan – both Dias and Azamat – to be transferred to Kazakhstan as convicted persons, it is necessary to either sign a Kazakhstan-US agreement on the transfer of sentenced persons or for Kazakhstan to access the American Convention on the Transfer of Sentenced Persons. Kazakhstan has done neither ore the two yet," he told the journalists.

He stressed that the Prosecutor General's Office of Kazakhstan and country's diplomats were doing everything possible to sign the agreement with the US on the transfer of sentenced persons.

Abibullayev said that Dias Kadyrbayev had a chance of getting an early release. The 26 months that he had spent in custody before the trial would also be counted towards his overall sentence of 72 months. “In addition, according to the American law, a sentence may be reduced by 15 percent each year for good behavior,” Abibullayev said.
