All Kazakhstan businesses must accept bank cards from January 1

Kazakhstan's small businesses must start accept bank cards starting from January 1, 2013, KazTAG reports referring to Kazakhstan Law On payments and transfers amended in November 2012. However, the Law has some exceptions. "The obligation to install the equipment for bank card payments does not apply to legal entities and individual entrepreneurs performing wholesale and retail sales of self-made agricultural goods, self-made aquaculture (fishing) goods and those performing activities via remote counters, shop cars, tents, stalls, containers and at the territory of the markets located in the areas with no general-use communications networks," the law says. But this exception is there only for the year 2013. Starting from January 1, 2014, the regulation on payment cards will cover all the traders and those performing paid services, regardless of their taxation regime. Besides, Kazakhstan Code on Administrative Violations now has an article providing administrative liability for lack of equipment (unit) for acceptance of payment via bank cards. This regulation came into effect on January 1, 2013. The administrative violation cases on article 161-2 of Kazakhstan Administrative Violations Code shall be reviewed by tax authorities.
