Tengrinews.kz – President Kassym-Jomart Tokayev has signed the law "On the Ratification of the Agreement between the Republic of Kazakhstan and the Republic of Cyprus on the Transfer of Convicted Persons."

The official announcement was released by the press service of Akorda on Wednesday, April 16.

The agreement was signed in Astana in March of last year.

Earlier, on April 10, the Senate deputies ratified the document.

In accordance with the agreement, the parties undertake to transfer to each other convicted persons who have been sentenced to imprisonment so that they can continue serving their sentence or the remainder of it in their country.

The Prosecutor General's Office has been determined as the body responsible from Kazakhstan for the execution of decisions on the transfer of convicted persons. The agreement establishes specific grounds for both the transfer of convicted persons and for refusing to do so

Transfer is possible if:

  • the convicted person is a citizen of the state to which he is being transferred;
  • the court decision has entered into legal force in accordance with the legislation of the country that passed the sentence;
  • the remaining term of the sentence is at least six months, or the sentence is not limited by the term;
  • there is the consent of the convicted person;
  • the act for which the person was convicted is also considered a crime under the laws of the receiving party;
  • both parties - the one issuing the sentence and the one executing it - agree to the transfer.

At the same time, the transfer may be refused if it may harm the sovereignty, security or public order of the country that issued the sentence, if the convicted person has not compensated for the damages ordered by the court, and also if the person is still being prosecuted in the country that issued the sentence.

Recall: On March 25, in Astana, as part of the official visit of the Minister of Foreign Affairs of Cyprus to Kazakhstan, a ceremony was held to sign an agreement between the two countries on the transfer of convicted persons.
