Tengrinews.kz - Kazakhstan is considering introducing criminal liability for stalking.
According to Mazhilis deputy Abzal Kuspan, the working group has already approved this provision, and the draft law is expected to be submitted for a second reading soon.
"We have included this provision in the draft law on optimizing the Criminal, Criminal Executive, and Criminal Procedure Codes. The working group has approved it. There will be a special article for stalking, classified as a criminal offense. We plan to bring the document to the chamber for consideration next week or the week after. This provision is part of the draft law and was initiated by deputies," Kuspan stated.
The proposed penalty for stalking is a fine.
"We’re not aiming to apply it broadly to everyone. Since the second reading hasn’t passed yet, it’s difficult to discuss the exact fine amount as it may change during the plenary session. The concept exists, and this provision serves as a preventive measure against more serious and particularly grave crimes," he added.
When asked why stalking wasn’t classified as a more serious criminal offense with harsher penalties, the deputy responded:
"What’s the necessity? Can you justify what’s abnormal about this approach? Our goal when introducing new provisions into the Criminal Code is to proceed cautiously. We need to observe law enforcement practices, investigative procedures, and judicial applications. Based on the results of these analyses, we could consider tougher sanctions in the future," Kuspan explained.
Stalking is a form of harassment characterized by obsessive and unwanted attention toward a person. It may include surveillance, threats, blackmail, unwanted calls or messages, appearing near the victim, or interfering in their personal life.
