The Head of State signed the law, titled "On the ratification of the Agreement between the Republic of Kazakhstan and the Socialist Republic of Vietnam on the transfer of convicted persons."

The text of the law is being published in the press.

The agreement sets out specific conditions and procedures for transferring convicted individuals, including the requirement for written consent from the individual or their legal representative, which must be given voluntarily and with full awareness.

The conditions for transfer specified in the document include:

  • The convicted person must be a citizen of either Kazakhstan or Vietnam.
  • The offense for which they were convicted must be recognized as a crime in both countries.
  • At the time of the transfer request, the convict’s sentence must be final, with at least one year remaining in their sentence.
  • The sentencing country must have no ongoing criminal proceedings against the individual.
  • Both countries must mutually agree to the transfer.
  • The convicted person or their legal representative (in cases of age, physical, or mental incapacity) must provide written consent.

Each country retains the right to make independent decisions regarding transfers, and any decision must be justified. The agreement also outlines rules on expenses, procedures for resolving disputes over interpretation or application of the agreement, and other relevant conditions.

Earlier, senate deputies ratified an agreement between Kazakhstan and Vietnam on the transfer of convicted persons.
