Kazakhstan and Vietnam ratified agreement on transfer of criminals

Tengrinews.kz - Senate deputies ratified an agreement between Kazakhstan and Vietnam on the transfer of convicted persons.
The agreement between the countries outlines the conditions and procedures for transferring convicted individuals. The convict or their legal representative must submit written consent, which should be given voluntarily and with full awareness.
The document also sets the following conditions for the transfer of a convicted person:
- the convicted person must be a citizen of Kazakhstan or Vietnam;
- the act for which they were convicted must be recognized as a crime in both countries;
- at the time the transfer request is received, the sentence must be legally binding, and the remaining term to be served must be at least one year;
- the sentence has entered into force, and there are no other criminal proceedings in the transferring country regarding the individual;
- both parties must agree to the transfer;
- written consent from the convict or their legal representative is required if the convict is unable to give consent due to age, physical, or mental condition.
Each party retains the right to make an independent decision on the transfer, and any decision must be justified. The document also includes provisions regulating expenses related to its implementation, as well as the procedure for resolving disputes between the parties related to the interpretation or application of the agreement.
Previously, the bill ratifying the agreement between Kazakhstan and Vietnam was approved by the Mazhilis.
According to the General Prosecutor's Office, there are currently no Vietnamese nationals serving sentences in Kazakhstan, nor are there Kazakh nationals serving sentences in Vietnam.
