Tengrinews.kz - Minister of Justice Yerlan Sarsembayev commented on the situation with the disappearance of Kazakhstani music from Instagram and told how the department plans to resolve this issue.
Answering questions from a Tengrinews.kz correspondent, Sarsembayev said that negotiations are currently underway between the Kazakhstan Authors' Society and the Meta platform.
"Last fall, these contractual relations were terminated by mutual consent of the parties. However, as far as we know, negotiations are currently underway between the interested parties. The issue of their interaction with the Ministry of Justice is to regulate these legal relations in accordance with the law. We do not intend to force anyone or impose certain actions. Our task is to create legal mechanisms for regulating these legal relations. Moreover, I have already reported this to the government," the minister replied.
The Minister also recalled that the department is working on creating a digital platform that, according to the Ministry of Justice, will allow authors to control the use of their works.
When asked whether this means that the state will not interfere in the negotiations, Sarsembayev replied:
"Well, how do you imagine it? If this is freedom of contractual relations, it excludes state interference in the negotiation process and coercion to conclude contracts. The issue may drag on indefinitely, since the final decision depends on the parties reaching an agreement. In situations where we are talking about contractual relations, the state should not set strict deadlines or force the parties to take mandatory actions, especially in relation to third countries. Our goal is to make these legal relations transparent and predictable, which is what the Ministry is currently doing."
By the way, after the situation with the disappearance of Kazakh music from Meta platforms, the authorities decided to modernize the system of collective rights management.
Last December, Kazakhs noticed that most of the songs by local artists had disappeared from Instagram, and their tracks could no longer be added to publications. The incident drew attention to the problem of copyright in the country. As Vice Minister of Justice Botagoz Zhakselekova explained, the reason is the lack of agreements between Meta and one of Kazakhstan's collective rights management organizations (CRMO).
