Kazakhstan’s former ambassador to Austria Rakhat Aliyev will not be released on bail if he requests a bail hearings, Tengrinews correspondent reports citing the speaker for the Vienna Prosecutor’s Office Thomas Vecsui.

"Releasing individuals on bail is not applicable under the Austrian procedural law for murder cases,” he said.

Rakhat Aliyev was arrest in Austria on June 5. The Austrian authorities are now investigating his involvement in the kidnap and murder of two Kazakhstan's bankers Zholdas Timraliyev and Aibar Khasenov.

Kazakhstan offered assistance and support in the investigation. The Austrians agreed to take into consideration all the available information, but made it clear that no charges had been leveled against the suspect at that point.

Representatives of the Viennese law enforcement agencies said that since his arrest the Kazakh oligarch had not made any statements or explain the reason why he decided to give himself in. Aliyev’s lawyer Manfred Aindter declared earlier this month that the ex-ambassador voluntarily surrendered himself to the Austrian law enforcement in order to cooperate in the investigation.

The Viennese prosecutors said that Aliyev was in Justizanstalt Wien-Josefstadt prison, located right next to the Vienna criminal court. The institution is known for its soft regime. Ukrainian billionaire Dmitry Firtash was also kept here.

The Austrian prosecutors confirmed that two other individuals were arrested along with Rakhat Aliyev. According to Austrian radio O1 one of them was a former head of the National Security Service Alnur Musayev.

Back in Kazakhstan Aliyev was sentenced to 40 years in prison for crimes that include the murder of the two Kazakhstani bankers, treason and preparing a coup d'etat.
