Pre-trial hearings on the case of Kazakhstan students accused of conspiring to destroy evidences of Boston bombing will not take place earlier than in July, Interfax-Kazakhstan reports citing the attorney of one of the students Arkady Bukh. “They scheduled us for the same date as Tsarnayev’s case. We will have the hearing on the same day,” Bukh told Interfax-Kazakhstan last Saturday. The hearings on Dzhokhar Tsarnayev accused of organizing the Boston bombings are scheduled for July 10. He explained that holding related hearings on the same day is a normal practice in the U.S. “This is typical to schedule everyone for the same day, one after another. The hearings will be on different days only when it gets to the jury trial,” Azamat Tazhayakov’s attorney said. The lawyer said that the judge will ask the students whether they want to admit their guilt during the hearing. If the answer is positive, the judge will consider remission of the sentence. If not, they will schedule a jury trial where we will have to prove their innocence. “I think that they will not schedule the jury trial at the next hearing. It may turn out that they will reschedule the hearing two or three times, set deadlines and then finally schedule the hearing in 1.5 years,” Bukh said. Meanwhile, he said that the defenders plan to request the hearings to be held not in Boston but in some other city to ensure the trial’s neutrality. “We are currently working on a petition to transfer this case from Boston to new York, for example. We believe that it will be impossible to have a fair jury trial in Boston because of the hype around this case,” the attorney stressed. “The jury has to consider what they hear during the hearing, not what they get from the media. It is difficult to find such people in Boston, while it is more likely, for example, in New York, even though it may be quite difficult,” Bukh believes. Besides, he mentioned that results of the expertise won't be available any time soon. “Normally all this (tests) starts several months before the jury trial even before it is scheduled. It can take years to get to the jury trial, if any is scheduled at all. Jury trial is a long story,” he said. Earlier Tengrinews.kz reported that the 19-y.o. Kazakhstan students are accused of conspiring to destroy evidences in the Boston bombings case. The students may be sentenced to 5 years in jail and a penalty of $250 thousand. The students have confessed that they took the backpack and the laptop. The evidences were later found at a waste dump. FBI believes that “they took the backpack from Dzhokhar Tsarnayev’s room after they heard on the news that Dzhokhar was suspected of committing the terrorist attack.”
